Judge Day directed court staff to use the court record system to investigate whether couples wishing to marry were of the same sex and, if so, to represent that he was unavailable, rather than unwilling, to marry them.

Lambda Legal joined Barber v. Bryant, the federal challenge to HB 1523, Mississippi’s discriminatory anti-LGBT legislation, which was brought by Mississippi civil rights attorney Robert McDuff and the Mississippi Center for Justice.

The court unanimously rejected the arguments of a florist who refused on religious grounds to sell flowers to a same-sex couple for their wedding.
