"One of the 40 men charged in a city park sex sting last year filed a federal lawsuit against the city and Johnson City Police Chief John Lowry because he says the police department gave his arrest excessive publicity.
"Attorneys for Kenneth Giles filed the suit in U.S. District Court in Greeneville. It seeks monetary damages and injunctive relief because Lowry and the city violated Giles' right to equal protection under the 14th Amendment of the U.S. Constitution, according to the complaint.
"Giles is represented by Lambda Legal, which according to its Web site, 'is a national organization committed to achieving full recognition of the civil rights of lesbians, gay men, bisexuals, transgender people and those with HIV through impact litigation, education and public policy work.'
"A news release about Giles' lawsuit is posted on the organization's Internet site.
"'The focus of this case is how the police did something with respect to our client and the other men that were arrested that they didn't do any other time,' Greg Nevins, the supervising senior staff attorney in Lambda Legal's Atlanta office, told the Press.
"...According to Nevins, Lambda Legal reviewed JCPD's press releases for a one-year time frame and 'out of approximately 600 other releases, none pertaining to arrests was accompanied by photos or personally approved by the chief.'"
