On October 6, 2014, the U.S. Supreme Court allowed marriage case decisions from the Seventh Circuit, Fourth Circuit and Tenth Circuit Courts of Appeal to stand, meaning that same-sex couples in Indiana, Wisconsin, Virginia, Utah and Oklahoma would be able to marry.

The following day, the Ninth Circuit Court of Appeals struck down the discriminitory marriage bans for same-sex couples in Nevada and Idaho.

Thursday, October 9, 2014, 4:14pm EST:

Thursday, October 9, 2014, 3:00pm EST: The Coalition for the Protection of Marriage, the organization that had been defending Nevada’s discriminatory marriage ban, has withdrawn motions that it had filed before the U.S. Supreme Court and the U.S. Ninth Circuit Court of Appeals seeking to prevent the Ninth Circuit’s Tuesday ruling striking down the marriage ban from going into effect. “Finally, the confusion has ended and the Ninth Circuit’s decision is final and fully in effect. While the trial court will enter an order in the case finalizing relief, nothing prevents marriages from beginning immediately for same-sex couples in Nevada,” says Lambda Legal Staff Attorney Tara Borelli.

Thursday, October 9, 2014, 11:11am EST: "We hope Idaho will also soon be able to join the list of states where couples are marrying. We have an additional marriage case pending in Arizona at the federal district court — which is within the 9th Circuit’s jurisdiction — and we expect the court there to rule quickly now that the 9th Circuit has issued its decision. Other states with marriage bans in that circuit are Alaska and Montana. Once all the states in the 4th, 7th, 9th, and 10th Circuits follow the lead of their courts of appeal, same-sex couples will have the freedom to marry in 35 states and the District of Columbia – 16 more than just last week!" Read more from Jon Davidson, Legal Director and Eden/Rushing Chair at Lambda Legal.

Wednesday, October 8, 2014, 4:33pm ESTThis afternoon the U.S. Supreme Court Justice Anthony Kennedy issued an order clarifying that there is no stay on the Ninth Circuit’s decision as it applies to Nevada. Jon W. Davidson Legal Director and Eden/Rushing Chair at Lambda Legal issued the following statement: “As we had hoped, the Supreme Court has clarified this morning’s order and explained that there is no stay of the Ninth Circuit’s mandate as to Nevada. The temporary stay applies only to Idaho. We are delighted and hope officials in Nevada will continue to move quickly, as they had been, to start issuing marriage licenses to same-sex couples.”
