(Miami March 23, 2017) –Today, the U.S. District Court for the Northern District of Florida ruled that the state must issue accurate death certificates to all surviving same-sex spouses.
(Miami June 20, 2016) – Lambda Legal today announced it has filed papers with the U.S. District Court for the Northern District of Florida asking the court for a swift end to the harm and indignity that Florida same-sex spouses, like gay widowers Hal Birchfield and Paul Mocko, face when denied accurate death certificates that acknowledge they were married and recognize them as surviving spouses.
Late yesterday, Lambda Legal filed a motion seeking class action status in its federal lawsuit on behalf Hal Birchfield and Paul Mocko, two gay widowers. The motion for class certification would extend the scope of those represented in the lawsuit to all same-sex spouses whose marriages Florida unconstitutionally disregarded at the time of their spouses’ deaths and who wish to obtain accurate death certificates.
(Miami, October 22, 2015) — At a hearing today, the Miami-Dade County Office of Property Appraisal agreed to reinstate the spousal homestead protections of Lambda Legal client Hal Birchfield, a gay widower previously denied protections against certain tax increases for the home he had shared with his husband because his marriage was not recognized at the time of his husband’s death.
