It is no surprise that a lively discussion has developed after news broke about an appeal we filed in an HIV criminalization case. We represent Nick Rhoades, an HIV-positive man living in Iowa who was sentenced to 25 years in prison and life time sex offender status as a result of a one-time sexual encounter with another man during which they used a condom.

Today Lambda Legal filed an appeal on a petition for post-conviction relief in the Iowa Supreme Court on behalf of an HIV-positive Iowa man, Nick Rhoades. Rhoades was sentenced to 25 years in prison and lifetime registration as a sex offender after having a one-time sexual encounter with another man during which they used a condom.

Today, New York Court of Appeals dismissed an aggravated assault conviction based on HIV status and remitted the case back to Herkimer County Court for resentencing.

Lambda Legal has filed a friend-of-the-court brief urging New York State's highest court to drop the aggravated assault charge leveled at a criminal defendant based on his HIV status.

A bill under consideration by the New York state legislature would prevent police and prosecutors from using possession of condoms as evidence of prostitution and prostitution-related offenses.

The LGBT community encompasses not only bi-national same-sex couples and LGBT asylum-seekers, but also undocumented LGBT immigrants who are often trapped in a “double closet.”

As the nation turns its eyes toward the Supreme Court and its review of the Patient Protection and Affordable Care Act (the "ACA"), people living with HIV will be among those most anxiously awaiting the outcome.

Q. I recently tested positive for HIV, and a friend told me that I might have a hard time keeping health insurance if I changed jobs. What kind of insurance is available for me?

HIV/AIDS advocates justly celebrated enactment of the Patient Protection and Affordable Care Act (ACA), because of the greatly increased access to health care ACA would provide to improve HIV—related care and assist in curbing the HIV/AIDS epidemic in this country. For this reason, I knew Lambda Legal’s HIV Project had an interest in supporting the constitutionality of the law before the U.S. Supreme Court on behalf of HIV advocates.
